Tort Reform
The high costs associated with today’s medical liability system can have a negative impact on hospitals and their ability to provide services. SCHA supports reasonable tort reform that protects the patient and supports South Carolina’s healthcare providers.
Legislation to revise the South Carolina Tort Claims Act was introduced in 2019. SCHA opposed the unreasonable increases to the liability limits but recognizes that the current limits can be raised. We support the compromise legislation that increases the liability limits to $500,000 per person per occurrence and $1,000,000 cumulatively per occurrence.
SCHA will continue to monitor efforts to arbitrarily raise the liability limits on South Carolina’s hospitals and health systems. SCHA opposes unreasonable increases and additional exceptions to the Tort Claims Act.
